1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and RdPod ("we", "us") governing your access to and use of RdPod at https://rdpod.io and its API (the "Service"). If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.
2. The Service
RdPod aggregates publicly available marketplace and interest data and presents it as consumer-purchasing and interest trends for research purposes. The Service is informational only. It is read-only with respect to third-party platforms and does not act on your behalf on any external account.
3. Accounts & eligibility
- You must provide accurate registration information. New accounts may require approval before access is granted.
- You are responsible for keeping your credentials confidential and for all activity under your account.
- You must be of legal age to form a binding contract and not barred from using the Service under applicable law.
- Accounts are personal to you; do not share, sell, or transfer your account or access.
4. Acceptable use
You agree not to:
- scrape, harvest, resell, redistribute, or create a competing dataset or product from the Service or its output;
- access the Service by automated means beyond the interfaces we provide, or circumvent rate limits, authentication, or security controls;
- reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
- use the Service to violate any law or the terms of any third-party platform or data provider;
- upload malware, interfere with or disrupt the Service, or attempt to gain unauthorized access to any system or data;
- use the Service to derive or obtain non-public information about any individual.
We may monitor usage (including request logs and IP addresses) to enforce these Terms and protect the Service, and we may rate-limit, suspend, or terminate access for violations.
5. Third-party platforms and data
The Service reads data from third-party marketplaces and their APIs. Your use of any data originating from a third party is also subject to that provider's own terms and policies. RdPod is an independent tool and is not affiliated with, endorsed by, or sponsored by Etsy, Pinterest, or any other platform referenced in the Service. Where the Service uses the Pinterest API, it does so on a read-only basis solely to display aggregate public trend data, in compliance with the applicable Pinterest developer terms; see our Privacy Policy for details.
6. Intellectual property & license
The Service, including its software, design, and original content, is owned by us or our licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal research purposes. All rights not expressly granted are reserved. Third-party data remains the property of its respective owners.
7. Privacy
Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Availability & changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time, and data may be incomplete, delayed, or inaccurate. We do not guarantee uninterrupted or error-free operation.
9. Disclaimer of warranties
The Service and all data are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Trend information is provided for research only and is not business, financial, or legal advice; any decision you make based on it is your own responsibility.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 100.
11. Indemnification
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms or of any law or third-party right.
12. Suspension & termination
We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or to protect the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination (e.g. IP, disclaimers, liability, indemnification, governing law) will survive.
13. Changes to these Terms
We may update these Terms from time to time. We will change the "Last updated" date above and, for material changes, take reasonable steps to notify users. Your continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which RdPod is established, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction of the courts located there, unless mandatory local law provides otherwise.
